    2. For Clients: Your Data and Privacy

    What Client Information We Collect

    • Account Information: Name, email address, phone number, and profile picture
    • Appointment Details: Booking history, consultation notes, tattoo preferences, and scheduling information
    • Payment Information: Processed securely through Stripe (we never store your full payment details)
    • Design Assets: Reference images and AI-generated tattoo designs you create or upload
    • Communications: Messages exchanged with your selected artist through our platform
    • Google Calendar: If authorized, we access your calendar availability to prevent scheduling conflicts

    How We Use Your Client Information

    • Booking & Scheduling: To manage your consultation and tattoo appointments
    • Artist Matching: When you select an artist, they gain access to your profile, contact info, appointment history, and uploaded images to provide personalized service
    • Payment Processing: To securely handle consultation deposits and tattoo session payments
    • AI Design Tools: To generate custom tattoo designs based on your preferences and reference images
    • Reminders & Updates: To send appointment confirmations, reminders, and important notifications
    • Calendar Sync: To automatically add appointments to your Google Calendar if you've granted permission

    Who Can See Your Client Information

    • Your Selected Artist: Full access to your profile, contact details, appointment history, uploaded images, and messages for active client relationships
    • Platform Administrators: Limited access for support, dispute resolution, and platform maintenance
    • Payment Processor (Stripe): Handles payment transactions securely according to their privacy policy
    • Other Users: No access to your personal information

    How Long We Keep Your Client Data

    Your client data is retained as long as your account remains active. If you delete your account:

    • Personal information and uploaded images are permanently deleted within 30 days
    • Appointment records may be retained for up to 7 years for business and tax compliance
    • Payment records are retained according to legal requirements (typically 7 years)
    • You can request deletion of specific data at any time by contacting us

    3. For Artists: Your Data and Privacy

    What Artist Information We Collect

    • Professional Profile: Name, bio, specialty, experience, portfolio images, and profile photo
    • Business Information: Pricing structure, deposit amounts, availability settings, and blocked dates
    • Financial Details: Stripe Connect account information for payment processing and payouts
    • Client Management Data: Notes, tags, and records for clients who select you as their artist
    • Google Calendar Integration: If authorized, calendar access to sync your availability and appointments
    • Payment History: Transaction records, earnings, platform fees, and payout information

    How We Use Your Artist Information

    • Profile Display: Your profile, portfolio, and specialty are publicly visible to help clients find and select you
    • Booking Management: To manage your availability, appointments, and client scheduling
    • Payment Processing: To collect deposits from clients and transfer your earnings minus platform fees to your Stripe account
    • Client Relationship Tools: To help you manage client notes, tags, images, and appointment history
    • Calendar Synchronization: To check your availability and prevent double-booking by reading your Google Calendar free/busy status
    • Business Analytics: To provide insights on your bookings, earnings, and client activity

    Who Can See Your Artist Information

    • All Platform Users: Your public profile (name, bio, specialty, portfolio, experience) is visible to anyone browsing artists
    • Your Clients: Clients who select you can view your availability and communicate with you through the platform
    • Platform Administrators: Full access for support, payment verification, and platform operations
    • Financial Partners (Stripe): Access to your payout information and transaction history per their privacy policy
    • Other Artists: Cannot see your private client notes, financial details, or availability settings

    How Long We Keep Your Artist Data

    Your artist data is retained while your account is active. If you close your artist account:

    • Your public profile becomes inactive and is removed from artist listings
    • Client appointment records are retained for 7 years for business and legal compliance
    • Payment and tax records are retained for 7 years as required by law
    • Client notes and tags you created are permanently deleted within 30 days
    • Portfolio images can be deleted immediately upon request

    4. Google User Data - What You Need to Know

    Google OAuth & Limited Use Requirements

    Uprising.Ink uses Google OAuth for authentication and calendar integration. We comply withGoogle API Services User Data Policyincluding the Limited Use requirements.

    Important: Uprising.Ink's use of information received from Google APIs adheres to Google API Services User Data Policy, including the Limited Use requirements. We use Google data ONLY to provide and improve our tattoo booking services—never for advertising, data brokering, AI training, or any other prohibited purposes.

    What Google User Data We Collect

    When you use Google Sign-In or connect Google Calendar, we collect:

    • Google Account Information: Your name, email address, and profile picture from your Google account (used for authentication and account creation)
    • Google Calendar Free/Busy Data: Read-only access to your calendar's availability status (busy/free times) to prevent scheduling conflicts
    • OAuth Tokens: Secure access tokens to maintain your connection to Google services

    We DO NOT collect: Event titles, event descriptions, event locations, attendee lists, calendar content, or any other detailed calendar information beyond free/busy status.

    How We Use Google User Data

    • Authentication & Account Creation: Your Google account information (name, email, profile photo) is used to create and authenticate your Uprising.Ink account, eliminating the need for separate login credentials
    • Appointment Scheduling: We check your Google Calendar free/busy status to show you only available time slots and prevent double-booking
    • Calendar Sync (Optional): If enabled, we can add your tattoo appointments to your Google Calendar as events
    • Service Improvement: We may analyze aggregate usage patterns (non-identifiable) to improve our scheduling features

    Limited Use Commitment: We use Google user data ONLY for providing and improving the user-facing features of our tattoo booking service. We do NOT use Google data for:

    • Targeted or personalized advertising
    • Retargeting or interest-based advertising
    • Selling to data brokers or information resellers
    • Training AI or machine learning models
    • Determining creditworthiness or lending purposes
    • Creating user databases for sale or licensing
    • Any purpose unrelated to our core booking services

    How We Share, Transfer, or Disclose Google User Data

    We DO NOT sell, rent, or share your Google user data with third parties for their own purposes.

    Limited sharing occurs only in these specific circumstances:

    • Your Selected Artist: When you book an appointment, your name and email (from your Google account) may be shared with your assigned tattoo artist to facilitate your appointment
    • Google Services: Calendar sync requires communication with Google Calendar API (your data remains within Google's ecosystem)
    • Service Providers: Secure cloud infrastructure providers who store data under strict contractual obligations (they cannot use your data for any other purpose)
    • Legal Requirements: Only if required by law, court order, or governmental regulation

    We DO NOT transfer Google user data to third parties for advertising, data brokering, creditworthiness determination, AI training, or any purpose other than providing our tattoo booking services.

    How We Protect Google User Data

    • Encryption: All Google user data is encrypted in transit (TLS/SSL) and at rest using industry-standard encryption protocols
    • Secure Storage: Data is stored in SOC 2 compliant, enterprise-grade secure cloud infrastructure
    • OAuth 2.0 Security: We use Google's OAuth 2.0 protocol with secure token management and automatic token refresh
    • Access Controls: Strict role-based access controls ensure only authorized systems and personnel can access data
    • Regular Security Audits: Ongoing security assessments and vulnerability monitoring
    • Minimal Data Collection: We only request the minimum Google API scopes necessary for functionality
    • No Data Sharing: We never share Google user data with advertisers, data brokers, or unauthorized third parties

    Google Data Retention & Deletion

    • Active Use: Google user data is retained only while your account is active and Google services are connected
    • Disconnect Anytime: You can disconnect Google Sign-In or Google Calendar at any time from your account settings
    • Automatic Deletion: When you disconnect Google services, your Google OAuth tokens are immediately revoked and deleted
    • Account Deletion: When you delete your Uprising.Ink account, all associated Google user data (including name, email from Google, OAuth tokens) is permanently deleted within 30 days
    • Data Minimization: We do not retain Google Calendar event data—we only query it in real-time when checking availability
    • No Backup Retention: Google OAuth tokens are not included in routine backups

    Your Right to Delete: You can request immediate deletion of all Google-sourced data by emailing privacy@uprising.ink with "Delete Google Data" in the subject line. We will comply within 7 days.

    Your Control Over Google Data

    • Optional Integration: Google Sign-In and Calendar integration are completely optional—you can use Uprising.Ink without connecting Google
    • Revoke Access: Disconnect Google services anytime in your Uprising.Ink account settings
    • Google Account Settings: You can also revoke Uprising.Ink's access through your Google Account Permissions
    • Limited Scopes: We only request the minimum necessary permissions (userinfo.email, userinfo.profile, calendar.freebusy.readonly)
    • Transparent Communication: We will notify you if we ever need to request additional Google API scopes

    5. Data Storage and Security

    We implement industry-standard security measures to protect your personal information:

    • Encryption: All data is encrypted in transit (TLS/SSL) and at rest
    • Secure Infrastructure: Cloud storage with enterprise-grade security protocols
    • Access Controls: Role-based permissions ensure users only see data they're authorized to access
    • Authentication: Secure login with password protection and optional Google Sign-In
    • Payment Security: All payment data is processed by PCI-DSS compliant Stripe - we never store your full payment card details
    • Regular Audits: Ongoing security monitoring and vulnerability assessments
    • Data Backups: Regular automated backups to prevent data loss

    Important: While we implement robust security measures, no system is completely immune to security risks. We encourage you to use strong passwords and keep your login credentials confidential.

    Payment Method Storage & Authorization Holds

    To provide a seamless booking experience and reduce failed payments, we securely save your payment method through Stripe for future use when you book tattoo appointments scheduled more than 7 days in advance.

    • How It Works: When booking a tattoo appointment more than 7 days out, your payment method is securely saved by Stripe (not stored on our servers). An authorization hold is automatically created 6 days before your appointment to ensure the deposit can be collected.
    • Authorization vs. Charge: Authorization holds temporarily reserve funds on your card but do not immediately charge you. The charge is only processed after your appointment is completed or confirmed according to the booking terms.
    • Immediate Bookings: For appointments within 7 days, an authorization hold is placed immediately at booking to secure your deposit.
    • Your Control: You can view and manage your saved payment methods at any time. We send email notifications when your payment method is saved, when authorization holds are created, and if any issues arise (such as card expiration).
    • Security Measures: All saved payment methods are subject to 3D Secure verification, address verification, and CVC checks. We maintain a comprehensive audit log of all payment method access and authorization activities.
    • Consent: By completing a booking, you explicitly consent to having your payment method saved and authorize us to create authorization holds as necessary to secure your appointment deposit.
    • Stripe's Role: Stripe handles all payment method storage according to PCI-DSS compliance standards. We never have direct access to your full card details.

    6. Third-Party Services

    We work with trusted third-party service providers to deliver our services:

    • Stripe: Handles all payment processing, deposit collection, and artist payouts. Stripe processes payment data according to their privacy policy and PCI-DSS standards
    • Google: Provides authentication (Sign in with Google) and calendar integration for availability checking
    • AI Service Providers: Powers our tattoo design generator and intelligent placement recommendations
    • Cloud Infrastructure: Secure hosting and storage for all platform data

    We do not sell, rent, or share your personal information with third parties for their marketing purposes. Third-party services only access your data as necessary to provide specific platform functionality.

    7. SMS/Text Messaging Communications

    When you provide your mobile phone number and opt in to receive SMS/text messages during account registration or in your profile settings, we may send you appointment-related communications via text message.

    SMS Consent at Registration

    During account signup, you have the option to consent to receive SMS/text messages from Uprising Ink Tattoo Studio. This consent allows us to send you important notifications regarding your consultation and tattoo appointments with your assigned artist.

    Consent is voluntary and not required to use our services. You can opt in or out at any time.

    SMS Consent and Opt-In

    • Voluntary Consent: SMS/text messaging is optional. You must explicitly opt in to receive text messages from Uprising Ink by checking the SMS consent box during account registration or in your communication preferences
    • Types of Messages: You may receive appointment confirmations, reminders, rescheduling notifications, artist communications, and other tattoo appointment-related updates regarding your consultation and tattoo appointments
    • Message Frequency: Message frequency varies depending on your appointment schedule. You may receive up to 5 messages per appointment (booking confirmation, reminders, day-of notification, etc.)
    • No Purchase Required: Consent to receive SMS messages is not a condition of purchasing any goods or services from Uprising Ink
    • Data Rates: Standard message and data rates may apply based on your mobile carrier plan. Check with your carrier for details
    • Carrier Liability: Carriers are not liable for delayed or undelivered messages

    Supported Carriers

    Our SMS service is compatible with major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers. Availability may vary by location.

    Opt-Out and Help

    • STOP to Opt Out: Reply STOP to any text message to unsubscribe from SMS communications. You will receive a confirmation message that you have been unsubscribed
    • HELP for Support: Reply HELP to receive customer support information and contact details
    • Account Settings: You can also manage SMS preferences in your Uprising Ink account settings under Communication Preferences
    • Effect of Opt-Out: Opting out of SMS messages will not affect your ability to use the Uprising Ink platform or receive email communications

    SMS Data Collection and Use

    • Phone Number: We collect and store your mobile phone number when you opt in to SMS communications
    • Message Logs: We maintain records of SMS messages sent to you for appointment management and support purposes
    • Delivery Status: We track message delivery status to ensure you receive important appointment notifications
    • No Marketing Without Consent: We will not send you promotional or marketing SMS messages unless you explicitly opt in to receive them separately
    • Third-Party Provider: SMS messages are sent through Twilio, our secure messaging service provider, which handles message delivery according to their privacy policy and telecommunications regulations

    A2P 10DLC Compliance

    Uprising Ink complies with U.S. telecommunications regulations for Application-to-Person (A2P) messaging using 10-Digit Long Code (10DLC) numbers. Our SMS program is registered with mobile carriers and follows CTIA Messaging Principles and Best Practices.

    8. Your Rights and Choices

    For All Users (Clients & Artists)

    • Access: Request a copy of all personal data we have about you
    • Correction: Update or correct inaccurate information in your profile
    • Deletion: Delete your account and request removal of your personal data (subject to legal retention requirements)
    • Export: Download your data in a portable format (JSON/CSV)
    • Opt-Out: Unsubscribe from marketing emails (appointment notifications will still be sent)
    • Revoke Permissions: Disconnect Google Calendar integration at any time
    • Object: Object to certain data processing activities

    Additional Rights for Clients

    • Request deletion of uploaded images and AI-generated designs
    • Change your selected artist (previous artist will lose access to your data)
    • Download all your appointment history and payment records

    Additional Rights for Artists

    • Update your public profile, portfolio, and availability settings at any time
    • Request detailed payment and earnings reports
    • Export client appointment history for your records
    • Make your profile inactive without deleting your account

    9. Cookies and Tracking

    We use cookies and similar technologies to enhance your experience, analyze usage patterns, and remember your preferences.

    • Essential Cookies: Required for authentication, security, and core platform functionality
    • Preference Cookies: Remember your settings and preferences
    • Analytics Cookies: Help us understand how you use the platform to improve services
    • Your Control: You can control cookie settings through your browser preferences. Note that disabling essential cookies may limit platform functionality

    10. Data Retention

    We retain your personal information for as long as necessary to provide our services and comply with legal obligations:

    • Active Accounts: Data retained while your account is active and for legitimate business purposes
    • Deleted Accounts: Personal information deleted within 30 days, except as noted below
    • Financial Records: Retained for 7 years per IRS requirements and Nevada state law
    • Appointment Records: Retained for 7 years for business compliance and tax purposes

    11. International Data Transfers

    Uprising.Ink is based in Las Vegas, Nevada, United States. Your information may be transferred to and processed in the United States or other countries where our service providers operate.

    • Primary Location: All data is primarily stored and processed in United States-based secure data centers
    • Service Providers: Third-party services (Stripe, Google, AI providers) may process data internationally according to their privacy policies
    • Safeguards: We ensure appropriate contractual and technical safeguards are in place for international transfers
    • EU/EEA Users: For users in the European Economic Area, we comply with GDPR requirements for international data transfers

    12. Children's Privacy (COPPA Compliance)

    Our services are STRICTLY for individuals 18 years of age or older. Tattoo services require clients to be legal adults under Nevada law (NRS 597.840).

    • Age Verification: We require users to confirm they are 18+ during account creation
    • No Children's Data: We do not knowingly collect, use, or disclose personal information from anyone under 18
    • Parental Notice: If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately at privacy@uprising.ink
    • Prompt Deletion: We will promptly delete any information we discover was provided by someone under 18
    • COPPA Compliance: This policy complies with the Children's Online Privacy Protection Act (COPPA)

    13. Nevada Residents - Your Specific Privacy Rights (SB 220)

    Under Nevada law (Nevada Revised Statutes 603A.340), Nevada residents have the right to opt-out of the sale of their personal information.

    Important Notice for Nevada Residents:

    We DO NOT sell your personal information to third parties. We have not sold personal information in the past 12 months, and we have no plans to sell personal information in the future.

    If our practices change in the future, we will update this policy and provide Nevada residents with a clear mechanism to opt-out as required by Nevada law.

    Additional Nevada Privacy Rights:

    • Right to Opt-Out: Even though we don't sell data, you may submit a verified request to opt-out at any time
    • No Discrimination: We will not discriminate against you for exercising your Nevada privacy rights
    • Security Measures: We maintain reasonable security measures as required by NRS 603A.215
    • Breach Notification: Nevada residents will be notified of data breaches as required by Nevada law (see Section 14)

    Nevada Residents (NRS 603A.220):

    • We will notify you without unreasonable delay if your personal information was, or is reasonably believed to have been, acquired by an unauthorized person
    • Notification will be provided by email, written notice, or substitute notice as appropriate
    • Notice will include the date or estimated date of the breach, a description of the information compromised, and steps you can take to protect yourself
    • We will also notify the Nevada Attorney General if the breach affects 500 or more Nevada residents

    All Users:

    • Notification Timeline: Affected users will be notified within the timeframes required by applicable law (typically within 30-60 days)
    • Information Provided: Nature of the breach, types of data affected, steps taken to secure data, recommended actions for affected users
    • Remediation: We will take immediate steps to contain the breach, prevent further unauthorized access, and implement additional security measures
    • Assistance: We will provide resources and assistance to help affected users protect their information

    Regulatory Notifications:

    We will comply with all applicable data breach notification laws and notify relevant authorities including state attorneys general, the Federal Trade Commission, and data protection authorities as required by law.

    17. Automated Decision-Making and AI

    We use artificial intelligence (AI) and automated systems in limited ways:

    • AI Tattoo Design Generator: Creates custom design suggestions based on your text descriptions and reference images. These are suggestions only - all final design decisions are made by you and your artist
    • Intelligent Placement Recommendations: AI analyzes body placement options and provides suggestions. Final placement is always determined by you and your artist
    • No Automated Decisions: We do not use AI or automated systems to make decisions that significantly affect your rights (booking approvals, pricing, account status, etc.)
    • Human Oversight: All booking confirmations, payment processing, and customer service decisions involve human review
    • Your Control: You can choose not to use AI features and opt for traditional consultation and design processes

    18. Email Communications and CAN-SPAM Compliance

    We comply with the CAN-SPAM Act for all commercial email communications:

    • Identification: All emails clearly identify Uprising.Ink as the sender
    • Accurate Headers: Email headers, "From," "To," and routing information are accurate
    • Clear Subject Lines: Subject lines accurately reflect the email content
    • Opt-Out Mechanism: Marketing emails include a clear unsubscribe link that is honored within 10 business days
    • Physical Address: All emails include our valid physical business address (1631 E Sunset Rd c103, Las Vegas, NV 89119)
    • Transactional Emails: Appointment confirmations, reminders, payment receipts, and security alerts are transactional and cannot be unsubscribed from (required for service delivery)
    • Your Preferences: Update your email preferences at any time in your account settings

    19. Do Not Track (DNT) Signals

    Some web browsers offer a "Do Not Track" (DNT) signal. Our platform does not currently respond to DNT signals because there is no industry-wide standard for how to interpret and respond to these signals. You can control tracking through your browser cookie settings and our cookie preferences.

    We may update this privacy policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.
